Artikel 1: Identiteit van de Ondernemer

Artikel 2: Toepasselijkheid

1. Deze algemene voorwaarden zijn van toepassing op elk aanbod van toffmerch.com en op elke totstandgekomen overeenkomst op afstand tussen toffmerch.com en consument.

2. Voordat de overeenkomst op afstand wordt gesloten, wordt de tekst van deze algemene voorwaarden aan de consument via de site beschikbaar gesteld. Indien dit redelijkerwijs niet mogelijk is, zal voordat de overeenkomst op afstand wordt gesloten, worden aangegeven dat de algemene voorwaarden bij de ondernemer zijn in te zien en zij op verzoek van de consument zo spoedig mogelijk kosteloos worden toegezonden.

Artikel 3: Bestellen

  1. Toffmerch.com accepteert bestellingen via ingave van uw bestelling op de website. Bij onvolledig ingevulde of onduidelijke bestellingen houden wij ons het recht voor niet te leveren. Bestellingen worden behandeld in volgorde van binnenkomst en geleverd zo lang de voorraad strekt.
  2. Toffmerch.com behoudt het recht voor om een bestelling te weigeren of de bestelling aan voorwaarden te verbinden.
  3. Uw bestelling houdt aanvaarding in van de van toepassing zijnde algemene voorwaarden.
  4. Na iedere voltooide bestelling volgt een bevestiging per mail naar het door consument opgegegeven e-mail adres. Toffmerch.com is niet verantwoordelijk voor de goede ontvangst daarvan.
  5. Toffmerch.com is niet aansprakelijk voor evt. afwijkingen in de stock. Mocht het bestelde item onverhoopt niet meer in stock zijn alhoewel wél zo aangegeven op de site dan zal Toffmerch.com de consument daarvan op de hoogte brengen en hem een alternatief aanbod doen.

Artikel 4: Levering en Transport

  1. De wijze van transport voor levering wordt uitsluitend door Toffmerch.com bepaald.
  2. Toffmusic.com zal de consument de transportkosten van bestelling kenbaar maken op faktuur voor betaling.
  3. Toffmusic.com beoogt de consument een zo gunstig mogelijk transportaanbod te doen op basis van een combinatie van laagste prijs en acceptabele leveringsperiode.
  4. Toffmerch.com kan niet aansprakelijk worden gesteld voor niet tijdige leveringen, zal zich echter inspannen om bestellingen martkt-conform te leveren.
  5. Verwachte lever-termijnen zijn te bezien in de FAQ
  6. Transport van bestelde artikelen zal geschieden naar het door consument opgegeven. Toffmerch is niet aansprakelijk voor fouten in adres dan wel de onvolledigheid daarvan. Mocht bestelling retour komen, door  fouten in adres dan wel een voor transporteur onmogelijke uitreiking, dan behoudt Toffmerch.com zich het recht voor de consument een extra voor een hernieuwd transport in rekening te brengen.

 

Artikel 5: Bedenktermijn & Terugsturen

  1. De consument beschikt over een bedenktermijn van 14 kalenderdagen, ingaande op de dag na ontvangst van de bestelling.
  2. Tijdens de bedenktermijn bent u gerechtigd de bestelde artikelen op kwaliteit en uitvoering te beoordelen. Artikelen zullen alleen in nieuw-staat worden teruggenomen.
  3. Wenst de constument van de bedenktermijn gebruik te maken, dan dient die de geleverde artikelen, onbeschadigd, samen met een kopie van van de faktuur, uiterlijk binnen 14 kalenderdagen na ontvangst van de artikelen, voldoende gefrankeerd,  aan ons terug te sturen. Voor het opsturen dient consument telefonisch dan wel per e-mail contact op te nemen om de retour aan te kondigen.
  4. Transport van retour geschiedt volledig op risico van consument.
  5. Voor een omruiling binnen de BeNeLux is de consument verantwoordelijk voor het retourtransport. Toffmerch.com zal de kosten aanvaarden voor hernieuwd opsturen van (geruild) product.
  6. Voor omruilingen buiten BeNeLux is consument verantwoordelijk voor retourtransport. Toffmerch.com zal niet zonder meer de kosten voor hernieuwd transport voor zijn rekening nemen. Onderling zal Toffmerch met consument daar een afspraak over maken.

Artikel 6: Betalen

  1. Al onze fakturen zijn betaalbaar bij bestelling, betalen bij ontvangst behoort niet tot de mogelijkheden.
  2. Toffmerch.com biedt consument aan te betalen via bancaire overschrijving, Paypal en iDeal (Sisow)
  3. Deze betaalmogelijkheden worden kenbaar gemaakt bij het uitchecken en als keuze aan de consument aangeboden.
  4. Bij betaling via Paypal of iDeal (Sisow) gaat de klant automatisch een overeenkomst aan met ons moederbedrijf Toffmusic BVBA.
  5. Terugbetaling van retouren zal geschieden binnen 14 dagen na ontvangst en op zelfde account als waarvandaan de consument ons betaald heeft. Maar nooit voor het pakket ons bereikt heeft dan wel een bewijs is overhandigd waaruit blijkt dat het pakket naar ons verzonden is.

Artikel 7: Privacy

  1. Gegevens van consument worden opgeslagen in een verwerking en gebruikt voor interne, geautomatiseerde verwerking in het kader van verantwoord klantenbeheer en van onze bedrijfsvoering, zoals bijvoorbeeld verwerking van bestellingen alsmede voor het toesturen van eigen aanbiedingen. Wij verstrekken geen gegevens aan derden die uw persoonlijke levenssfeer aantasten.
  2. De consument bezit uiteraard het recht van verbetering van zijn/haar gegevens. Deze kan consument telefonisch dan wel per e-mail doorsturen.Privacy Statement

    Upon your request to terminate your account, we will deactivate or delete your account and information from our active databases.     1. CONTROLS FOR DO-NOT-TRACK FEATURES

      

    Most web browsers and some mobile operating systems and mobile applications include a Do-Not-Track (“DNT”) feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. At this stage no uniform technology standard for recognizing and implementing DNT signals has been finalized. As such, we do not currently respond to DNT browser signals or any other mechanism that automatically communicates your choice not to be tracked online. If a standard for online tracking is adopted that we must follow in the future, we will inform you about that practice in a revised version of this privacy notice. 

      

    1. DO CALIFORNIA RESIDENTS HAVE SPECIFIC PRIVACY RIGHTS?

      

    In Short: Yes, if you are a resident of California, you are granted specific rights regarding access to your personal information.

Artikel 8: Diversen

  1. Toffmerch.com is niet aansprakelijk voor gevallen van toeval of overmacht. In deze gevallen worden de wederzijdse verbintenissen opgeschort, indien deze omstandigheden langer dan één maand aanhouden.
  2. In geval van geschillen is de Belgische wet van toepassing. Geschillen die niet in der mine kunnen worden geschikt zullen worden voorgelegd aan het Gerecht te Turnhout.
